4) The Indian Government is extending the lockdown with the Rs.20 lakh crores monetary package:

5) Study reports that the death rate for Indians under 5 has fallen by 49 percent since 2000:

1) India ranks 74th in the Global Energy Transition Index 2020 according to the WEF:

Q.) WHAT DO YOU MEAN BY CROSS EXAMINATION? WHY IS IT IMPORTANT?

Ans) Cross examination is a technique that is implemented and practiced by prosecutors by the means of direct examination. It is used to enquire averse deponent in depositions and in civil and criminal trials.

Cross examination is a sharp art in which the probability of explanation of witness answers are low. Basically, used to impeach a witness in the following ways:

  • It reveals the witness character whether biased, prejudiced, lying or is an egotism.
  • Shows witness past behavior usually dismally or has been charged with a crime like deceit and lying.
  • Uncovers witness reputation when it comes to truth telling.

Cross examination is a type of interrogation by the opposing party of the witness that is called for testing. If a party calls a witness to provide testimony and statements in its favor, the party opposing the claim has the right to examine such a witness. Examination- in- chief occurs after cross examination which is the examination of the witness by the party being called. Both examination must relate to the relevant facts.

GOALS OF CROSS EXAMINATION:

  • Authenticates the evidence of the state’s witnesses.
  • Acquires genuine acknowledgement that are supportive to the state’s case.
  • Lessen the defense case by impeachment of the witness on the stand.
  • Minimize the defense case by impeachment of other defense witnesses through the witness on the stand.

THE TEN COMMANDMENTS WHILE CROSS EXAMINING:

  • Be brief.
  • Use short questions with plain words.
  • Ask only leading and suggestive questions.
  • Never ask a question to which you do not know the answer.
  • Listen to the answers given by the witness.
  • Do not quarrel with the witness.
  • Don’t let the evidence (witness) clarify.
  • Do not ask the witness to repeat the testimony he/she gave in-chief.
  • Avoid long questions.
  • Save the explanation for summation.

IMPORTANCE OF CROSS EXAMINATION:

  • Builds credibility.
  • Creates clarity.
  • Constructs cracks.
  • Used for confirming and evaluating the truth of a person’s testimony, to develop the testimony further and to achieve other objectives.
  • The aim of a cross examination is to investigate the evidence and try the reliability of a witness who has been called and given proof in-chief.
  • Cross examination is an effective tool which is devised for the ascertainment of truth, discredit and impeach the testimony of a witness, assist evidences that are favorable to the side of a cross examiner and provides independent proofs beneficial to the position of a cross examiner.

It is a very powerful mechanism which testifies the veracity of a witness and the accuracy or completeness of what he/she says. It is a form of intensive questioning with the expected answers hinted to in such questions itself.

The cross examination is also known as” ex-adverso”, used to expose the inaccuracies of the evidence of a particular witness.

Section 146 in the Indian Evidence Act 1872 says that a witness during cross examination, may, in addition to the questions herein before referred to, be asked any questions which tend

  • To test his veracity.
  • To find out who he is and what his place in life is.
  • Shaking his reputation by damaging his character whether the answer to these questions may tend to criminalize him directly or indirectly, or may expose him or tend to expose him to a fine or revocation, directly or indirectly.

 

Q.) GIVE A LIST OF DO’S AND DON’TS FOR AN EFFECTIVE CROSS EXAMINATION.

Ans) DO’S OF CROSS EXAMINATION:

1. Have a command on leading questions only-:

By doing so, the witness is permitted to answer only “yes” or “no”.

2. Restrictions on questions-:

Try to control the questions you ask. Use only simple and easy questions. Do not ask open ended questions, narrative generating questions, compound, and multipart questions.

3. Limit the level of flow-:

Conduct cross examination in an order and by subject matter. Always ask questions in a sequence that tells a story which is followed easily. Try to use descriptive words to highlight the significant points. Impeach the credibility of a witness before attacking the credibility of his/her testimony.

4. Restrain to the subject matter-:

Do not allow the witness to restate his straight testimony. Refuse to explore uncharted territory and use verbatim notes on the witness’s direct testimony.

5. Be polite and courteous-:

Create the impression of being friendly and fair. Do not be harsh and overbearing. This will make a pleasant courtroom atmosphere, appealing to jurors, and does not alienate them from your client.

6. Keep faith on questions that you ask-:

Have a good faith basis for questions that you ask, if challenged by your opponent and are unable to provide sufficient proof for your question.

7. Begin with major points-:

When the jury finishes listening to the direct examination then start their thought processes to be in your favor by using extensive details.

8. Wind-up the cross examination with favorable points-:

Leave strong impression and thoughts on jury while ending the case using major points.

9. Organize the case-:

If the case is well ordered, the jury will not only appreciate the lawyer but also move the case rapidly and back to work sooner.

10. Use of space in the courtroom-:

Try to maintain distance and position. It keeps the jury more alert and contributes to emphasis and effect.

DON’TS OF CROSS EXAMINATION:

1. Never argue with a witness-:

The examiner should not argue or quarrel with the witness. Overcome the situation by eliciting the answers you need or use skillful questioning for the responses.

2. Don’t answer the questions for an opposing witness-:

The examiner should never respond to the opposing party, as by doing so the control goes in the favor of the witness rather to the lawyer/examiner.

3. Never argue with the judge-:

Try to make strongest argument while being respectful towards the judge. Do not argue in front of the jury and audience as it will lead to a mortal sin against self-control. Be a loyal examiner during the case as much as you can.

4. Don’t persecute yourself by your opponent-:

The opposing counsel will try to bait you so that you may lost your control and make mistakes. Do not be tempted and baited (mostly used in depositions, courtrooms and even over phones). Stay confident and play your game without losing self-control and concentration at your client’s expense.

5. Don’t let the jury know and see that your case has been hurt by an answer-:

Never reform your demeanor, expression, and the pace of your cross examinations. If you do, you risk revealing that your case has been hurt and damaged. This time requires utmost self-control. 

6. Don’t “KILL” a witness unless the jury wants him to be demolished-:

Never try to stab the bull. If the examiner plunges the sword into the body of the bull, the crowd might feel sorry for that bull.

7. Don’t cross examine if there is no impact-:

If no result, outcome, and impression appears by cross examining then announce that you have no questions. This itself will carry a big impact.

8. Don’t re-affirm points that hurt you-:

Avoid giving opportunity to the witness who has given direct testimony against you and to repeat that testimony.

9. Don’t rely on the judge to discipline the witness-:

Try to control the witness by your own. Do not call upon judge as it will lead to the weakness of courtroom. Judge should be used as a last resort.

10. Don’t be cocky and arrogant-:

Try to keep the tone in a respectful and truth-seeking manner. Ask as many killing questions as you can but do not let the jury to see you as a conceited examiner.

1) Maharashtra CM Uddhav Thackeray joining unopposed Maharashtra Legislative Council:

महाराष्ट्र विधान परिषद में प्रवेश करने के लिए महाराष्ट्र के सीएम उद्धव ठाकरे निर्विरोध।

Maharashtra CM Uddhav Thackeray is good to go to join the unopposed Maharashtra Legislative Council which was affirmed after the congress pronounced on May 10, 2020 that he would pull back one of his two candidates for the May 21 MLC elections.

1) Ministry of Health administering Sero Survey in chosen areas:

स्वास्थ्य मंत्रालय चयनित जिलों में सेरो सर्वे करेगा:

On May 11, the Ministry of Health and Family Welfare consented to direct a populace based Sero survey in the chosen regions aiming to track the pattern in COVID-19 disease pervasiveness. According to the ministry, the Indian Medical Research Council (ICMR) and the National Center for Disease Control (NCDC) will lead a sero study in the chosen regions where RT-PCR samples will be obtained for the surveying  throat and nasal swabs and this observation will be notwithstanding standard testing according to the current test rules.

2) Center grants Rs.6,195 crore fund to 14 states to counter pandemic COVID-19:

Basics of a Resume:

  • It is a 1-2-page summary of your work experience, skills, achievements, background, and credentials.
  • The main purpose of a resume is for job application, to share all credentials for employment, admission in universities or other professional purposes.

Sections:

A good resume includes following sections: –

  • Header/Personal Details- Your information and contact details like name, email id, address, and phone number.
  • Objective- What are your requirements and objectives.
  • Education- Includes all your qualifications, institute name and other specialization or educational achievements.
  • Practical/Experience/ Projects- It includes recent job including position, name and location of organization and dates of employment. Also mention your role, responsibilities, achievements, internships, and volunteer work.
  • Skills- These are the strengths, personality traits, occupational skills, and list of information that you are seeking in a job.
  • Interests- It includes all your professional aspects.
  • References- A referee should be included at the bottom of a resume. By using the name of a referee, you make sure to ask their permission first otherwise write “References available on request”.

Guidelines for Resume header:

  • only give basic information that you want to share like name, current address, email id, phone number etc.
  • Do not include your photo, date of birth, marital status etc.
  • Do not give unnecessary details like family information and don’t use vague statements like “I have excellent communication skills” etc.

Guidelines to the Objectives:

  • The main purpose is to convey what your goal is.
  • The objective should include the position, functional area, and industry of your choice.
  • Keep in mind that objective is not about what you want but it’s the company needs.

For e.g.:

# If you are a job seeker: – Use trainee as a position or a beginner in a company.

# If you are seeking an internship: – Use ‘intern’ in which role you’ve applied.

Guidelines to the Education:

  • The main purpose of the education section is to provide all the basic qualification for the job or internship.
  • It includes the qualification details from class 10th to present, school/college name, board, specialization, year of passing and marks/CGPA.
  • Remember to write all qualifications in chronological order and use tabular format.

Length of a resume:

Always keep your resume short and concise up to 2 pages.

Format and style:

The design and layout of your resume should be neat and use paragraphs and bullet points.

Do’s in your resume:

  • Start from a template.
  • Mention your relevant experience.
  • Keep your resume short around 800 words.
  • Include a summary statement.
  • Do run a spell check.
  • Include your soft skills like “effective communicator” etc.
  • Do include your non-experience work and volunteer work.
  • Mention your extracurricular accomplishments.

Don’ts of a resume:

  • Don’t use obvious skills like ‘using the internet’.
  • Don’t use undermining words like ‘first time’, ‘myself’ etc.
  • Avoid use of many fonts.
  • Don’t include anything private and confidential.
  • Don’t try to hide gaps if any during academic. Be honest and confident in the truth.
  • Don’t use negative phrases like ‘fixed problem’ etc.

The Council for Scientific and Industrial Research (CSIR) has obtain endorsement for the treatment of COVID-19 for two clinical preliminary medications – ‘phytopharmaceutical’ and ‘favipiravir,’ where endorsement was granted by the Drug Controller General of India (DGCI).

NATIONAL AFFAIRS:

1) India and AIIB conclude a USD 500 million aid agreement to COVID-19:

भारत और AIIB ने USD 500 मिलियन COVID-19 समर्थन के लिए समझौते पर हस्ताक्षर किए:

The Asian Infrastructure Investment Bank (AIIB) has consented to an arrangement with the Indian government to give USD 500 million worth of funding to help India’s “COVID-19 Emergency Response and Health Systems Preparedness Program,” which will assist India extend its reaction to the COVID-19 pandemic and improve general wellbeing preparedness for the country.

एशियन इन्फ्रास्ट्रक्चर इन्वेस्टमेंट बैंक (AIIB) ने भारत के “COVID-19 इमरजेंसी रिस्पांस एंड हेल्थ सिस्टम्स प्रिपेरडनेस प्रोजेक्ट” का समर्थन करने के लिए 500 मिलियन अमरीकी डालर के फंड उपलब्ध कराने के लिए भारत सरकार के साथ एक समझौते पर हस्ताक्षर किए हैं। यह परियोजना भारत को COVID-19 महामारी के प्रति अपनी प्रतिक्रिया देने और देश की सार्वजनिक स्वास्थ्य तैयारियों को मजबूत करने में मदद करेगी।

2) UP CM Yogi Adityanath introduced the Pravasi Rahat Mitra App for supporting migrants:

यूपी के सीएम योगी आदित्यनाथ ने प्रवासी नागरिकों की सहायता के लिए प्रवासी राहत मित्र ऐप लॉन्च किया:

Uttar Pradesh Chief Minister Yogi Adityanath propelled the ‘Pravasi Rahat Mitra’ application created by the Department of State Revenue in a joint effort with the United Nations Development Program (UNDP) to enable migrant individuals from different states to Uttar Pradesh to take benefits of government plans.

उत्तर प्रदेश के मुख्यमंत्री योगी आदित्यनाथ ने Ra प्रवासी राहत मित्र ’ऐप लॉन्च किया। इस कदम का उद्देश्य अन्य राज्यों से उत्तर प्रदेश में आने वाले प्रवासी नागरिकों को सहायता प्रदान करना है ताकि वे सरकारी योजनाओं का लाभ उठा सकें। ऐप को संयुक्त राष्ट्र विकास कार्यक्रम (UNDP) के सहयोग से राज्य के राजस्व विभाग द्वारा विकसित किया गया था।

3) To survey the effect of the COVID-19 pandemic, the legislature of Tamil Nadu structures a high-level committee:

तमिलनाडु सरकार ने COVID-19 महामारी के प्रभाव का आकलन करने के लिए उच्च-स्तरीय समिति का गठन किया:

The legislature of Tamil Nadu has formed a high-level committee to evaluate the overall quick and medium-term effect of COVID-19 on the state economy headed by Dr. C Rangarajan, previous Indian Governor of the Reserve Bank.

तमिलनाडु सरकार ने राज्य की अर्थव्यवस्था पर COVID-19 के समग्र तत्काल और मध्यम अवधि के प्रभाव का आकलन करने के लिए एक उच्च-स्तरीय समिति का गठन किया है। इस समिति की अध्यक्षता भारतीय रिजर्व बैंक के पूर्व गवर्नर डॉ सी रंगराजन करेंगे।

4) Under the Sarfaesi Act SC puts cooperative banks on a standard with different moneylenders:

सुप्रीम कोर्ट ने अन्य उधारदाताओं के साथ एक सममूल्य पर सरफेसी अधिनियम के तहत सहकारी बैंकों को रखा:

The Supreme Court brought cooperative banks under the 2002 Securitisation and Reconstruction of Financial Assets and Security Enforcement Act (Sarfaesi Act), which engages lenders to seize and sell the assets of defaulters.

5) Phytopharmaceutical, favipiravir sedate preliminary endorsed by DGCI to treat COVID-19 patient:

The Drug Controller General of India (DGCI) endorsed for the Council for Scientific and Industrial Research (CSIR) the clinical preliminaries of the medications namely, phytopharmaceutical and favipiravir. 

ड्रग कंट्रोलर जनरल ऑफ इंडिया (DGCI) ने काउंसिल फॉर साइंटिफिक एंड इंडस्ट्रियल रिसर्च (CSIR) के लिए फ़ेथोफार्मास्यूटिकल और फ़ेविपिरविर नामक दवाओं के नैदानिक परीक्षणों को मंजूरी दी।

6) Chief of Wipro and MD Abidali Z Neemuchwala ventures down:

विप्रो के सीईओ और एमडी अबिदाली जेड नीमचवाला ने पद छोड़ दिया:

CEO and Managing Director Abidali Z Neemuchwala of Wipro Limited has chosen to step down because of family duties where Neemuchwala will keep on holding the job of CEO and Managing Director until a replacement is named for a smooth change and to guarantee that business proceeds as normal.

1) On the 40th commemoration of the eradication of smallpox, the WHO and UN post office issue memorial postage stamps:

डब्ल्यूएचओ और संयुक्त राष्ट्र की डाक एजेंसी ने चेचक के उन्मूलन की 40 वीं वर्षगांठ पर स्मारक डाक टिकट जारी किया:

On 9 May, the World Health Organization and the UN postal office released a memorial postage stamp to recognize the 40th commemoration of the eradication of smallpox, where the WHO’s crusade for the annihilation of smallpox was propelled in 1967 to bring issues to light of smallpox worldwide through post stamps.

विश्व स्वास्थ्य संगठन और संयुक्त राष्ट्र की डाक एजेंसी ने चेचक के उन्मूलन की 40 वीं वर्षगांठ मनाने के लिए 9 मई को एक स्मारक डाक टिकट जारी किया है। डब्ल्यूएचओ का चेचक उन्मूलन अभियान 1967 में शुरू किया गया था। डब्ल्यूएचओ ने डाक टिकटों के माध्यम से दुनिया भर में चेचक के बारे में जागरूकता बढ़ाई।

2) IEA’s Global Energy Assessment reports that the market for electricity is down by 15 percent:

आईईए की वैश्विक ऊर्जा की समीक्षा में बिजली की मांग में 15 प्रतिशत की गिरावट आई है:

The International Energy Agency (IEA) published the Global Energy Review in 2020 where it reported that 15 percent of the everyday demand for power was decreased as it featured carbon dioxide emanations and worldwide demand for energy in 2020.

इंटरनेशनल एनर्जी एजेंसी (IEA) ने 2020 में ग्लोबल एनर्जी रिव्यू जारी किया। रिपोर्ट में कहा गया है कि दैनिक बिजली की मांग का 15% कम हो गया है। इसने वर्ष 2020 में कार्बन डाइऑक्साइड उत्सर्जन और वैश्विक ऊर्जा मांग पर प्रकाश डाला।

                                                        Since ancient time, we all are known that there was no such awareness in the Indian society regarding the women’s education and the women were facing very vulnerable position in the society but with the development of time, this point was kept in view and a stand had been taken for this. Now – a – days, the concept of equality can be seen in respect of social, economic & political aspects. The concept of women empowerment is achieving its height so as to maintain a status of equality in the society. As we all know that if we educate a girl, we can make the two families better. The government is taking various steps regarding literacy of women in the country. Women are also proving themselves as there is no field in which women cannot work from household up to defence. 

In India, there is still a conservative thinking because of which somewhere parents do not let their daughters or sisters to step out of their cities but the facilities of women’s educational institutions, they can go & raise themselves in their better version as it criteria of security assures by these institution to the parents. Lady Shri Ram women’s College, Delhi:
